Terms & Conditions

TERMS & CONDITIONS

ALL BOOKINGS ARE SUBJECT TO THE FOLLOWING TERMS & CONDITIONS.


Please ensure you read and understand the following terms and conditions regarding your accommodation rental. If you have any queries, please do not Hesitate to Contact us (thereafter called the Owner) for clarification before you sign the Booking form.

 This letter shall be governed by and construed in accordance with  english law and any dispute arising out of, or in connection with, the terms of this letter shall be subject to the exclusive jurisdiction of   the English courts


Whilst we reserve the right to increase or decrease accommodation prices at any time, we will confirm to you the current price at the time of booking. As soon as you have confirmed your booking and paid your deposit or full payment, the cost of rental is guaranteed against any further increase. This guarantee

is offered subject to your terms and conditions and payment being adhered to and providing you do not make any further amendments to your holiday arrangements.


Your holiday home rental includes: Accommodation as booked including services: Water, Electricity, (excludes Pool Heating unless otherwise stated).

NOT included in our rental prices: Flights, Car Hire, Travel

Insurance, Pool Heating.


BE VACATED BY 10.00 A.M. ON THE DAY OF DEPARTURE.


A) The booking form and Terms & Conditions form has been completed, signed and the relevant parts returned.

B) The appropriate deposit/payment has been paid.

C) The booking has been confirmed in writing by the Owner to the

Guest.


2. The person who signs the Booking Form certifies that he/she is authorised to agree the Booking Terms & Conditions on behalf of all persons included on the Booking Form, including those substituted or added at a later date. The signatory must be a member of the party occupying the rental property and must be

over 21 years of age.

 Bookings cannot be accepted from parties of people under 21 years of age.

3.A Non-Refundable deposit of £200/$ 300 must accompany all bookings.

 The balance must be paid ten weeks prior to commencement of the Accommodation rental along with a Security Deposit of £200/$300.

 If the booking is less than ten weeks before departure, then the total amount is to be paid in full.

The Security Deposit will be returned to the Guest 7-10 days after completion of the holiday as long as there is no damage to the premises or contents, and no loss, breakages, exceptional cleaning reported by the Owner's Management Company or excessive telephone usage( i.e more than would be reasonable to expect) . If any damage is reported with costs in excess of £200/$400, we reserve the right to claim this from the Guest.

We reserve the right to treat the booking as cancelled if we do not receive the balance by the due date. Cancellation charges (as below) will then apply.


4.Any cancellation must be in writing-THE EFFECTIVE DATE is the date that written cancellation reaches us at the address below. If cancelled after final payment,

NO refund will be made. The Owner shall be entitled to retain all payments already made (except the Security Deposit).


In the unlikely event that circumstances beyond the Owner's control necessitate the cancellation of the rental arrangement, the Owner reserves the right to cancel any bookings at any time and will only be liable to refund monies already paid by the Guest. Furthermore, the Owner cannot guarantee that all the facilities described on their website will be available.


5.The Guest agrees to pay the full cost of any breakages, losses, extra cleaning costs or damage to the property (the Owner Management Company will be sole arbitrators on cause of damage or loss).

The Guests agrees to:

A) Take good care of the property and leave it in a clean and tidy Condition at the end of their stay.

B) To report any damage or loss IMMEDIATELY IT IS DISCOVERED to the Owner's Management Company in Florida. Any damage or loss found on arrival must be reported within 24-48 hours. If not, we will assume the Guest is responsible and reserve the right to claim for repairs or replacements from your Security Deposit.

C) To permit the Owner or their Agents reasonable access to the property to carry out repairs or maintenance if necessary.

D) Not to sub-let or share the property except with persons nominated on the Booking Form.

E) Not to park or store at any place on the property any commercial Or recreational vehicles, campers, mobile or motor homes, house-trailers or boats.

The connection of the house’s utility supplies to any external vehicle appliance is strictly prohibited.

6.No liability is accepted by the Owner for loss of main services or failure of appliances, nor the consequences of the actions or omissions of persons who may control supply of mains service, nor any actions taken in the vicinity of the property by any authority over which there is no control by the Owner.

7.The Owner does not accept any liability for injury, damage or loss caused by any reason or for any claim made as a result of this booking and/or the subsequent holiday. The Guest is responsible for taking out adequate insurance to cover all risks.

This waiver is also applicable to people visiting the property as guests of the Guest(s).

8.The Owner does not accept any liability for injury, damage or loss caused or for any such claim by a third party as a consequence of actions by the Guests and other people occupying the property during the period of rental arrangement.

9.Guests may use the swimming pool at their own risk. They should always observe the rules on the Pool Safety Notice displayed in the pool area.

10.If requested during initial booking, Pool Heating will be switched on during the day ordered and may take some time to heat the pool to the optimum temperature. Having ordered pool heating, the Owner is not responsible for the weather. We are unable to guarantee the water temperature with pool heating as this will depend on the prevailing weather conditions. If it is warmer than expected, pool heating still has to be paid for. The heater is a mechanical device, and as such, can be subject to electrical or mechanical failure. If this was to occur, every effort will be made to repair the heater. If the guest has paid for pool heat, then we shall refund only the days without pool heat. We cannot and will not refund for anything that has not

been paid for.

11.The pool is cleaned and chemically balanced every week for your safety and comfort. However, on rare occasions it may be necessary to apply extra chemicals to the pool to maintain safe and correct chemical levels. Should this occur during your stay, it will be necessary for you to be out of the pool for a period of 12-24 hours for safety reasons.

12.As Owners of the property, we, our servants or agents, will not be liable for any loss or delay occasioned by any of the following:

Strikes, riots, political unrest, war or the threat of war, terrorist activities, industrial disputes, fire, flood, technical/weather problems to transport, aircraft, closure of airports or any other event beyond the owners control.

13.The maximum occupancy is 10 persons plus 1 infant and is determined by the authorities within strict guidelines for fire safety. Please note that contravention of the above will render your booking void, all monies paid will be forfeited and you will be asked to leave the premises immediately without further compensation.

14.Strictly NO PETS OR SMOKING ALLOWED in the house at any time
For the comfort and convenience of all our guests the villa is a complete no smoking area. Smoking within the villa will result in the total loss of your security deposit and if discovered before your departure your party will be required to leave without compensation.
  If either of these are contravened at any time, the Owner reserves the right to withhold the full Security Deposit.

15. Excessive telephone usage. We do offer free National telephone calls but this is within reason. Any excessive usage that we would term

as out of the ordinary for either long periods of time and/or frequent daily use, will result in all or part of the security deposit to be withheld.

16. Our house is situated in a quiet, residential area. Please be considerate in your behaviour and keep the noise to a reasonable level so as not to disturb

our neighbours.


17 .Complaints: We sincerely hope you do not have any! But in the  unlikely event that you wish to register a complaint during your holiday, contact our Management Company immediately and follow this up with a letter. Give a copy to them and send us a copy on your return. Unfortunately, we are not always able to control the components of your rental accommodation, and it is possible that an advertised facility may be withdrawn or changed due to circumstances beyond our control and for which we cannot accept liability.

WE STRONGLY ADVISE ALL OUR GUESTS TO TAKE OUT TRAVEL INSURANCE FOR YOUR WHOLE PARTY WHICH INCLUDES CANCELLATION CHARGES COVER (UK GUESTS ARE ALSO ADVISED TO TAKE OUT MEDICAL COVER) AS SOON AS YOU HAVE BOOKED ANY PART OF YOUR HOLIDAY/VACATION. IF YOU CHOOSE NOT TO DO SO, YOU NEED TO BE AWARE THAT YOU WILL BE PERSONALLY RESPONSIBLE FOR PAYMENT OF ANY CANCELLATION CHARGES WHICH MAY BECOME DUE.
